Biteset Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Bufound LLC, doing business as Biteset (“Biteset,” “we,” “us,” or “our”). They govern your use of the Biteset mobile application and related services. By creating an account or using Biteset, you agree to these Terms. If you do not agree, do not use Biteset.

1. Eligibility

You must be at least 18 years old to use Biteset. You must also be legally able to enter into these Terms and use the service in the United States or Canada. Biteset is not intended for anyone under 18.

2. Your Account

You may sign in using an email verification code, Google sign-in, or Apple sign-in. You are responsible for keeping access to your email account, device, and sign-in credentials secure and for activity under your Biteset account. You must provide accurate information and keep it reasonably current. Tell us promptly at support@biteset.app if you believe your account has been accessed without permission.

3. Using Biteset

Biteset gives you tools to record and organize workouts, exercises, food, nutrition, weight, goals, progress, photos, and related information. You may use Biteset only for personal, lawful purposes and in accordance with these Terms.

You must not:

• Use Biteset in a way that violates law or another person’s rights.
• Upload content you do not have the right to use.
• Attempt to gain unauthorized access to Biteset, another user’s account, or connected systems.
• Interfere with, overload, reverse engineer, scrape, or misuse the service, except where applicable law clearly permits it.
• Use automated systems or repeated requests in a way that disrupts Biteset or unfairly consumes service resources.
• Use Biteset to create or distribute harmful, deceptive, or unlawful content.

4. Health, Fitness, and Nutrition Disclaimer

Biteset is a general fitness and nutrition tracking tool. It is not a medical device and does not provide medical advice, diagnosis, treatment, emergency services, or a substitute for professional care.

Exercise and dietary changes can involve risk. Before starting or changing an exercise, nutrition, or weight-management program, consider consulting a qualified healthcare professional, especially if you have a medical condition, injury, dietary restriction, are pregnant, take medication, or have concerns about your health. Stop exercising and seek appropriate help if you experience pain, faintness, breathing difficulty, or other concerning symptoms. In an emergency, contact emergency services.

You are responsible for deciding whether any workout, food choice, calorie target, macro target, weight goal, or other activity is appropriate for you. Do not rely on Biteset for decisions that require medical judgment.

5. Accuracy of Information

Workout calculations, calorie estimates, nutrient values, serving sizes, barcode results, food-database entries, and progress projections may be incomplete, outdated, or inaccurate. Information may come from you, third-party databases, or automated processing. Packaging and recipes can change, and similarly named foods can have different nutrition values. Check product labels and use your own judgment before relying on the information.

6. AI-Assisted Features

When you choose a nutrition-label or meal-photo scan, Biteset may use an external artificial-intelligence service to extract or estimate foods and nutrition information. AI results are estimates and can be wrong, including about ingredients, portions, calories, allergens, and nutrients. Review and correct results before saving or relying on them. Do not use AI results to manage a medical condition, allergy, intolerance, or other health risk.

7. Third-Party Services and Data

Biteset relies on third-party services, including Supabase, Google, Resend, OpenAI, USDA FoodData Central, and Open Food Facts. Those services may have their own terms and privacy policies. We do not control their availability or guarantee the accuracy, completeness, or continued availability of information or features they provide. Your use of a third-party sign-in or service may also be subject to that provider’s terms.

8. Your Content

You keep ownership of the information and photos you submit to Biteset. You give Biteset a limited, non-exclusive permission to host, copy, process, transmit, and display that content only as reasonably needed to provide, secure, maintain, and improve the features you choose to use. This permission ends when the content is deleted from our systems, subject to limited technical or legal retention described in the Privacy Policy.

You are responsible for your content and for ensuring that it is lawful and does not violate another person’s privacy, intellectual property, or other rights.

9. Biteset Intellectual Property

Biteset and its software, design, branding, text, and other service materials are owned by or licensed to Bufound LLC and are protected by applicable intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the app for its intended purpose. They do not transfer ownership of Biteset or its technology to you.

10. Price and Future Paid Features

Biteset v1 is offered without a subscription or in-app purchase. We may introduce paid features later. If we do, we will show the price and applicable purchase terms before you are charged. Your mobile platform’s payment terms may also apply to any future purchase.

In the current free v1 release, users may use up to five AI-assisted scans total across the nutrition-label and meal-photo features during any rolling 24-hour period. We may change these limits or discontinue free access to either scan feature in the future, including by making one or both features available through a paid plan.

11. Service Availability and Changes

We may update, change, suspend, or discontinue features to maintain, secure, or improve Biteset. We do not promise that every feature will always be available, uninterrupted, error-free, or compatible with every device. We will try to avoid unnecessary disruption, but outages and data-sync problems may occur.

12. Suspension and Termination

You may stop using Biteset at any time and may request account deletion in the app. We may limit, suspend, or terminate access if we reasonably believe you have materially violated these Terms, created risk or harm, used the service unlawfully, or threatened the security or operation of Biteset. When practical, we will provide notice and an opportunity to address the issue.

14. Disclaimers

To the fullest extent permitted by law, Biteset is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that Biteset or information available through it will be accurate, reliable, safe for your individual circumstances, uninterrupted, or free of harmful components. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, Biteset will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business opportunity, arising from or related to your use of or inability to use Biteset. Biteset’s total liability for all claims relating to the service will not exceed the greater of the amount you paid Biteset in the 12 months before the event giving rise to the claim or 100 U.S. dollars.

These limits do not apply where they are prohibited by law and do not limit liability that cannot legally be limited, including liability for fraud or willful misconduct.

16. Indemnification

To the extent permitted by law, you agree to reimburse Biteset for reasonable losses, liabilities, and costs arising from a third-party claim caused by your unlawful misuse of Biteset, your content, or your material violation of these Terms. This section does not require you to reimburse Biteset for claims caused by Biteset’s own negligence, willful misconduct, or violation of law.

17. Governing Law and Disputes

Kentucky law governs these Terms and disputes relating to Biteset, without regard to conflict-of-law rules. You and Biteset agree that disputes may be brought in a state or federal court with jurisdiction in Kentucky. Before filing a claim, each party agrees to make a reasonable good-faith effort to resolve the issue informally by written notice. Nothing in this section prevents either party from seeking urgent injunctive relief or using a small-claims court with jurisdiction.

18. Changes to These Terms

We may update these Terms as Biteset changes. We will post the updated Terms at biteset.app/terms and revise the effective date. If a change is material, we will provide additional notice when reasonably appropriate. Your continued use after the updated Terms take effect means you accept them; if you do not agree, you must stop using Biteset.

19. General Terms

If part of these Terms is unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. We may transfer these Terms as part of operating or reorganizing the Biteset service, provided that doing so does not reduce your rights under applicable law.
